BANGOR, Maine — Attorneys for nurse Kaci Hickox and the state have agreed that the temporary court order issued Friday by a Maine District Court judge will remain in place until 11:59 p.m. Monday, Nov. 10, when the 21-day incubation period for Ebola expires.



Judge Charles C. LaVerdiere signed the order Monday morning. It was posted on the court system’s website.


The evidentiary hearing that was scheduled to be held Tuesday and Wednesday at the Penobscot Judicial Center has been canceled, the order said.


Hickox, 33, of Fort Kent must continue, as she had already agreed, to submit to regular monitoring, including daily temperature and symptom checks and visits by public health authorities, according to the order, filed in Fort Kent District Court and posted on the court system’s website due to the interest by national media. She also must coordinate any travel with the state and immediately notify health officials if she develops symptoms, the order said.


Efforts to reach Hickox on Monday morning were unsuccessful.
“That’s fantastic,” her boyfriend, Ted Wilbur, 39, of Fort Kent called the decision in a telephone interview.


“We are very pleased with this resolution,” Hickox’s attorney Eric Saunders of Portland said Monday morning. “It was a negotiated resolution, which are generally the best.”


The attorney, who worked pro bono, or, without a fee on the case, said the decision applies only to Hickox and not to anyone else returning from treating Ebola patients in Africa.


Saunders said that Hickox and the Maine attorney general’s office, which filed the suit on behalf of Mary Mayhew, commissioner of the Department of Health and Human Services, agreed to make the temporary order permanent.


Timothy Feeley, spokesman for the attorney general declined to comment Monday.
Attorney General Janet Mills issued a statement Friday, when the temporary order was made public. Feeley said that statement applied to Monday’s decision as well.
“I am especially pleased that a well-respected member of the Maine judiciary crafted an order based on medical science, an order that accommodates the important constitutional liberty interests of the individual and the public interest in minimizing any potential risk of a disease such as Ebola,” she said in a statement released late Friday afternoon.


Maine became the first state in the nation to go to court to enforce restrictions on an individual potentially exposed to Ebola, according to the Maine chapter of the American Civil Liberties Union.


“The Maine court’s decision squarely recognized what the medical community has said about severe restrictions on people’s liberties not being justified at this time,” Alison Beyea, executive director, said Monday. “It should be precedent setting if not in fact than in spirit.”


Hickox tested negative for Ebola after returning two weeks ago from working for Doctors Without Borders in Sierra Leone. She also objected when the state of New Jersey put her into isolation when she arrived at Newark airport.


The confrontation between Hickox and officials in Maine has become the focal point of a dispute pitting several U.S. states opting for strict quarantines against the federal government, which opposes such measures. It also brought the national media to Fort Kent, whose trucks lined the road where the couple rented a house.


Wilbur said Monday morning that the reporters, photographers and television trucks have left.



“The snow drove them away,” he joked.

Summer, I've been thinking the EXACT same thing since this thread started. Did our "special snowflake" wake up feeling a little different this morning I wonder? Or maybe didn't feel all that well last night? Think about it (and yeah I know I'm reaching here but still) She gets all up in Christies face about being inconveinenced over a quarantine. Christie basically backs down and punts her to Maine. She goes there, threatens to put Maine through a lawsuit and is even MORE obnoxious than she was in Jersey if that is possible. She does the "it is a great day for a bike ride" tour with her partner/boyfriend/usefulidiot. NOW she decides to say "well ok, I'll listen to what you want me to do now and no more lawsuit"

Sorry guys. This is starting to smell big time to me. Just a feeling I have.

Funny...I was talking to someone yesterday and their comment was along the lines of "I know it sounds horrible, but I almost hope she turns up positive and teaches all the idiots a lesson." Since she has been seeking attention like a 1950s Hollywood starlet from the beginning, you do have to wonder why she didn't answer the phone, don't you?

She was on Face the Nation on Sun but only by telephone. No pics since Friday. That one showed her as stressed? Or something. I know she looked different than she has in previous pics. Something just a bit "off" about her face. Maybe a little pale? Not sure what but, I noticed it right away. She has been a walking/talking/bike riding madonna for the cameras and now nothing since Friday when she looked, well peaked.

Hickox does have the science behind her as well as many thousands of physicians, nurses and scientists.
Say what you want but this much is irrefutable except for opinions and emotion.
Just goes to show you that "MD" does not mean you know what you are talking about.

Good lord, I am SO glad you practice your "skills" a long way from where I live. Sounds like maybe you should go back to school also if you believe the CDC and their lies. There has been way too much truth posted by top doctors showing Kaci is endangering not only that town plus her boyfriend to possible ebola exposure. USAMRID for one. WHO for another and many other notable sources with hands on experience of ebola and symptoms, onset of symptoms and disease progression.

And no, I am not going to argue with you on this. Please refrain from your "science" on this thread. THank you.

Ok, I've re read the Doctors post and it looks like everything he wrote was correct and accurate. I would be grateful if you could point out which parts are wrong in your opinion.

Funny...I was talking to someone yesterday and their comment was along the lines of "I know it sounds horrible, but I almost hope she turns up positive and teaches all the idiots a lesson." Since she has been seeking attention like a 1950s Hollywood starlet from the beginning, you do have to wonder why she didn't answer the phone, don't you?

I don't like this woman, I freely admit it. I try to find something in my heart to fit in with love thy fellow man but its hard with her. But never ever do I wish this horrible disease upon any living soul. The reason isn't because I have this great heart because I don't always. The reason is Gods law or Karma. Its a selfish reason. I will pray for her health because God wants me to, and because I don't want this disease to spread and get near my family. At the same time, I'll pray for myself because I really don't like her and every time I feel venom like that towards another it always seems to edge me closer to being someone that I don't want to be.

Ebola has always been called 'THE NURSE KILLER'....for good reasons......she knew that going to Africa, she knew she took an oath to protect others from getting sick from a infectious disease, meaning she knew Quarentine was a possible precaution, yet she acted like an irresponsible person with now knowledge or conscience.

We should hold bad qualities like envy, greed, lust, pride, anger, deceit, malevolance and so on in abhorrance.

In fact, tolerating such bad qualities and the speech and actions they generate is absolutely wrong and is one of the reasons the world and our country is in the handbasket heading in a southerly direction.

We can and should pity those under the influence of such lower passions, and guard against them in ourselves.

What about the boyfriend? Should he have his own 21 day monitoring period? May be they can just keep passing the virus back and forth while playing house!
