Lawsuit challenges Northam’s temporary ban on all weapons on Virginia Capitol grounds

RICHMOND, Va. (WAVY) — A lawsuit challenging Gov. Ralph Northam’s executive order temporarily banning all weapons on Capitol grounds was filed Thursday. Northam (D) signed the executive order ahead of next week’s pro-gun rally on Lobby Day.

It is unclear who the plaintiff the lawsuit is at this time but the Virginia Citizen’s Defense League did threaten legal action before Northam made his announcement Wednesday.

A hearing will be held Thursday afternoon in Richmond Circuit Court, according to a spokesperson for Attorney General Mark Herring

FBI Arrest U.S. Army Veteran, 2 Other Suspected White Supremacists On Federal Firearms Charges In Maryland

GREENBELT, Md. (WJZ) —
Three Maryland area men, allegedly linked to a racially-motivated extremist group known as “The Base,” are facing federal firearms and alien-related charges.

Brian Mark Lemley, Jr. of Elkton, Maryland, and Newark, Delaware, and 19-year-old William Garfield Bilbrough IV of Denton, Maryland, were charged with transporting and harboring aliens and conspiring to do so.

Lemley, 33, was also charged with transporting a machine gun and disposing of a firearm and ammunition to an alien unlawfully present in the United States. He and 27-year-old Canadian national Patrik Jordan Mathews, currently of Newark, Delaware, were also charged with transporting a firearm and ammunition with intent to commit a felony.

Mathews was also charged with being an alien in possession of a firearm and ammunition.

According to the criminal complaint, The Base members have allegedly discussed violence against minority groups including African and Jewish Americans, creating a “white-ethnostate” and ways to make improvised explosives in encrypted chat rooms. They also allegedly discussed training camps and recruitment.

Lemly is a former Cavalry Scout in the U.S. Army and Matthews was a combat engineer in the Canadian Army Reserve.

Matthews unlawfully crossed from Canada into the U.S. near the Minnesota-Manitoba border on Aug. 19, 2019, according to documents. Authorities said Lemley and Bilbrough drove to pick up Matthews on Aug. 30, returning to Maryland the next day.

According to the affidavit, the trio made a functioning assault rifle in December. They also allegedly attempted to make a controlled substance, N,N-Dimethyltryptamine (DMT), at Lemley’s apartment. DMT is a hallucinogenic drug.

The trio also allegedly spoke about The Base’s activities and other members of the organization.

“In January 2020, according to the affidavit, that Lemley and Mathews purchased approximately 1,650 rounds of 5.56mm and 6.5mm ammunition; traveled from Delaware to a gun range in Maryland, where they shot the assault rifle; and retrieved plate carriers (to support body armor) and at least some of the purchased ammunition from Lemley’s prior residence in Maryland,” according to a press release from the U.S. Attorney’s Office in Maryland.

The charges were filed on Tuesday and were unsealed Thursday after the men were arrested by the FBI.

According to a federal official, the men were arrested near Baltimore and were believed to be heading toward Richmond.

On Wednesday, Virginia Gov. Ralph Northam declared a state of emergency ahead of a planned demonstration Monday at the State Capitol.

Northam said they have credible intelligence from law enforcement agencies of threats of violence including”extremist rhetoric” similar to what was seen before in major incidents such as Charlottesville in 2017.

“This intelligence suggests militia groups and hate groups, some from out of state, plan to come to the Capitol to disrupt our democratic process with acts of violence,” Gov. Northam said.

He said the state of emergency includes a ban on weapons of any kind in Capitol Square. It extends from Friday, January 17 at 5 p.m. until Tuesday, January 21 at 5 p.m.

Gun Groups Want Firearms Ban At Virginia Rally Overturned

Lemley and Matthews were ordered to be detained during a hearing Thursday afternoon in a federal court in Greenbelt.

They are expected to have hearings next Wednesday.

“If convicted, Lemley and Bilbrough each face a maximum sentence of five years for transporting and harboring certain aliens, and 10 years for conspiracy to do so. Lemley also faces a maximum of five years in prison for transporting a machine gun in interstate commerce, and a maximum of 10 years in federal prison for disposing of a firearm and ammunition to an illegal alien,” the press release stated. “Lemley and Mathews each face a maximum of 10 years in federal prison for transporting a firearm and ammunition in interstate commerce with intent to commit a felony offense. Finally, Mathews faces a maximum of 10 years in federal prison for being an alien in possession of a firearm and ammunition.”

(Reuters) - The FBI has arrested three suspected members of a neo-Nazi group who had a machine gun and hopes of sparking a U.S. race war at a planned gun-rights rally in Virginia that is expected to draw thousands of people, officials said on Thursday.

Among those arrested were a former cavalry scout in the U.S. Army and a Canadian citizen who was illegally in the United States and was a combat engineer in the Canadian Army Reserve.

The arrests came the day after Virginia Governor Ralph Northam declared a state of emergency banning any weapons around the grounds of the state capitol in Richmond, saying investigators had seen groups making threats of violence.

The FBI and the Department of Homeland Security have been sharply criticized for not focusing enough on the threat of far-right extremism following a spate of attacks on synagogues and a 2017 white-supremacist rally in Charlottesville, Virginia. Heads of both of those agencies have said in recent months that they were taking the threat more seriously.

Several thousand gun rights supporters are planning a large rally in Richmond, Virginia's capital, on Monday in response to the newly Democratic-controlled state legislature's push to stiffen gun laws.

Virginia, where Democrats took control of the legislature by promising stronger gun laws, has become the latest focal point for the contentious American debate around the right to bear arms. Many gun-rights groups contend the U.S. Constitution guarantees their ability to possess any firearm. Those opposed say gun laws would help lessen the number of people killed by guns each year.

According to a criminal complaint filed before the U.S. District Court for Maryland, the men arrested were Brian Mark Lemley Jr., who previously was in the U.S. Army; Patrik Jordan Mathews, a former Canadian military reservist; and William Garfield Bilbrough.

They are accused of interstate commerce of weapons, harboring illegal aliens, an alien in possession of a firearm and ammunition, and aiding and abetting. The FBI also said in the court filing that the men had attempted to manufacture DMT, a chemical resembling the structure of psilocybin in psychedelic mushrooms and an illegal drug under federal law.

While federal authorities can bring criminal terrorism charges against those suspected of working on behalf of foreign extremist groups like al Qaeda, they lack those tools when pursuing those affiliated with domestic extremist groups, whose views are protected by the free-speech clause of the U.S. Constitution.

The FBI said in the court filing that the three are members of the neo-Nazi group The Base. The FBI said in the court document that it had monitored encrypted chats among the group's members, in which they discussed creating a white ethno-state and carrying out acts of violence against minorities.
The men were in possession what appeared to be a fully automatic rifle, according to an FBI agent who watched the men fire the weapon at a gun range.

Shortly after firing the weapon on Jan. 2 at a Maryland gun range, Lemley told Mathews, "Oh, oops, it looks like I accidentally made a machine gun," according to the court document. The men were seen in possession of other guns, but the details were not included in the filing.

Lemley and Mathews lived together in Delaware, while Bilbrough resided in Maryland. Mathews illegally crossed over the border into the United States in August, according to the court document.

The FBI has arrested three alleged members of a neo-nazi hate group who were reportedly anticipating a possible race war and planning to bring firearms to a major guns rights demonstration next week in Virginia.

The three men — one of whom previously served as a trained combat engineer and explosives expert in the Canadian Army before his links to white supremacy emerged — were arrested in Maryland on Thursday morning.

Patrik Jordan Mathews, the 27-year-old former Canadian reservist and a main recruiter for the neo-nazi group, had reportedly entered the United States illegally ahead of the Virginia Citizens Defence League annual Lobby Day demonstrations set for Monday.

Brian M Lemley Jr, a 33-year-old former cavalry soldier in the US Army, was also one of the three men arrested by officials this week, along with 19-year-old William G Bilbrough. All three suspected members of the hate group known as "The Base" were expected to appear in federal court on Thursday afternoon.

The annual Lobby Day demonstrations have gained national attention by both proponents of the Second Amendment and gun control activists after Virginia’s General Assembly advanced four sweeping gun control bills, setting the stage for a potentially contentious showdown between both sides of the ideological divide.

Virginia Governor Ralph Northam has since declared a state of emergency and temporarily banned firearms from Capitol grounds, where the demonstrations are set to take place.

Philip Van Cleave, president of the Virginia Civil Rights Defence League, told The Independent in an interview the group’s lawyers are looking into whether the governor had the legal authority to temporarily ban firearms in a state known for its lax open carry laws.

“First of all, we don’t think it’s legal”, Mr Van Cleave said about the temporary ban. “We don’t think he has the power to do what he’s doing.”

The guns rights group has estimated as many as 100,000 demonstrators could flock to the city on Martin Luther King day for the demonstrations, and has scheduled charter buses throughout the state for its members hoping to attend the event.

In announcing the state of emergency, Mr Northam said in a statement there was credible evidence that “militia groups and hate groups, some from out of state, plan to come to the Capitol to disrupt our democratic process with acts of violence”.

“We have received credible intelligence from our law enforcement agencies of threats of violence surrounding the demonstration planned for Monday, January 20”, the governor wrote on Twitter.

Agencies around the Commonwealth have been doing this for the better part of two decades.

For instance, we found the predecessor to the military's modern day Mine Resistant Armored Vehicle also known as a MRAP. It's often used to transport soldiers and protect them from bombs. It's 24 feet across and weighs 25,000 pounds and you might see it on the streets of Caroline County.

"It didn't cost our taxpayers anything," said Caroline County Sheriff Tony Lippa.

How's that possible? They got it through what's called the military's 1033 program.

It's first come, first served. The military gives away its unwanted or out of commission items to local police....

They were without a doubt extremely civilized, law abiding and deeply anchored in the Bible and God as their guiding light. Yet, they came to the conclusion that enough was enough and they weren't gunna take no more shit from the tyrants in jolly O England. It was time to tell Caesar to go F himself. Shit got real. The founders were forced to deal with George and the House of Lords in the ONLY way that they would understand and also get the results they were seeking.

I'm sure that everyone has now heard that Governor Northam has declared a state of emergency and banned the carrying & possession of weapons on Capitol Square in Richmond from 5:00 pm Friday, January 17 to 5:00 pm on Tuesday, January 21.

VCDL believes that this gun ban is illegal. Our legal team is looking at our options and we will keep you advised as soon as we have a definitive plan. As it stands now, you can carry on 9th Street, or other nearby streets, as long as you don't go into the fenced-in Capitol grounds area (or into any of the government buildings). There will be 17 magnetometers to speed up security for those wishing to be on the Capitol grounds, which puts you near the stage. You CAN have a knife with a blade LESS THAN 3 inches. Again, wait for final word on the Capitol grounds gun-ban situation over the weekend.

Every year since 2002, VCDL has come to the General Assembly to peacefully assemble and lobby our elected officials on Martin Luther King Day. The only difference this year is that the crowd size is expected to be significantly larger due to the Democrat leadership's promise to pass draconian gun control laws that would adversely affect law-abiding citizens while having minimal impact on criminals.

The Governor claimed in his Executive Order that there has been credible intelligence gathered suggesting that the purpose of many of the participants in VCDL's Lobby Day is not to peacefully assemble but instead is to foment "violence, rioting, and insurrection." Yet, neither the Governor nor any of his law enforcement has informed VCDL of any of these alleged threats.

The inflammatory rhetoric from Democrats (including the Governor, Attorney General, Congressman McEachin, Delegate Levine, and many others) regarding the Second Amendment Sanctuary movement and VCDL's Lobby Day leads us to wonder if they really want Lobby Day to go peacefully.

The Democrats are afraid of the voters and want to portray this peaceful assembly of law-abiding gun owners in the worst possible way. They would love for it to degenerate to "violence, rioting, and insurrection" in order to smear gun owners. Has the Democrat leadership actually invited violent groups to attend for the purpose of disrupting our peaceful assembly?

SITUATIONAL AWARENESS: There have been many rumors, videos, and articles flying around the internet. We cannot stress enough that this is a peaceful day to assemble and address our Legislature about protecting our right to keep and bear arms. Lobby Day is NOT about statues, flags, racism, sexism, or anything other than protecting the right to keep and bear arms for ALL law-abiding citizens.

Yes, we hold a rally, but the point of the day is communication with our legislators. (Note that a rally is not the same thing as a protest.)

To our knowledge there are no credible threats of violence. That being said, please practice appropriate situational awareness. IF YOU SEE A BAD ACTOR flag down a police officer and point it out. If someone tries to provoke you, smile and walk away. There is probably someone secretly recording the interaction, with the intent of capturing some kind of inappropriate reaction on your part. Don't take the bait. It's not worth the bad press. Again, you might want to notify law enforcement of such bad actors.

The eyes of the nation and the world are on Virginia and VCDL right now and we must show them that gun owners are not the problem. Lead by example. We have been, and continue to be, in close contact with several law enforcement agencies and will keep them informed of all potential threats that we become aware of. Law enforcement will be in abundance at the event, both uniformed and plain clothes, to provide security and we are sincerely appreciative of their efforts to keep everyone as safe as possible.
