Daniel Penny faces up to 15 years on 2nd-degree manslaughter charge in chokehold death of Jordan Neely​

A grand jury has indicted former Marine Daniel Penny for the chokehold killing of homeless man Jordan Neely during a subway confrontation last month, sources have told The Post — even as Penny’s attorneys vowed to “aggressively defend” their client in court.

The Wednesday decision — made by a group of jurors sitting in Manhattan — arrives weeks after Neely’s caught-on-camera death sparked a national firestorm over Penny’s actions and intense scrutiny of the floundering mental health system that failed to help his victim.

Penny, 24, now faces one charge of second-degree manslaughter and another charge of criminally negligent homicide.

The former could put him in state prison for up to 15 years; the second could lead to another four years behind bars.

Penny’s attorneys said they were fully committed to clearing his name.

“While we respect the decision of the grand jury to move this case forward to trial, it should be noted that the standard of proof in a grand jury is very low and there has been no finding of wrongdoing,” Steven Raiser, of the law firm Raiser & Kenniff, said in a statement.

“We’re confident that when a trial jury is tasked with weighing the evidence, they will find Daniel Penny’s actions on that train were fully justified.”

Right now, the former infantry squad leader is free on $100,000 bail.

He first surrendered himself to cops on May 12 — nearly two weeks after he laced his arms around Neely’s neck during a chaotic confrontation on an F train in Manhattan.

Eyewitnesses say Neely — who had a long history of mental illness and scores of run-ins with New York’s Finest — was yelling at other straphangers, threatening them and throwing trash around.

In a series of videos released Sunday, Penny said he felt an obligation to step in.

“If [Neely] had carried out his threats, he would have killed somebody,” Penny said.

Penny seized him from behind with a common grappling technique called a rear naked choke, and dropped to the ground as he and two other men tried to restrain the struggling 30-year-old.

A freelance journalist who happened to be on the subway recorded the tail end of the fatal encounter, and the footage sparked immediate outrage after its release.

Penny said he wasn’t trying to kill Neely when he grabbed him — but he couldn’t sit around while Neely ranted.

“There’s a common misconception that Marines don’t get scared. We’re actually taught one of our core values is courage, and courage is not the absence of fear but how you handle fear,” he said.

“I was scared for myself but I looked around there was women and children, he was yelling in their faces saying these threats. I just couldn’t sit still.”

The city medical examiner later ruled Neely’s death a homicide, and said the troubled former street performer died from “compression of the neck.”

After his death, Neely’s family blamed authorities for not making sure he got the care he needed. And they’ve called for Penny to face murder charges.

During a fiery eulogy last month, the Rev. Al Sharpton told a packed church that “when they choked Jordan, they put their arms around all of us.”

Sharpton also criticized authorities’ initial decision to release Penny in the wake of the killing, asking, “Who thought it was alright for this man to choke a brother to death and go home to see his family?”

After the indictment, Sharpton released another statement saying the grand jury “saw right through [Penny’s] false narrative by voting to move this case forward.”

“This was a clear-cut case of vigilantism that has no place in our society, which is why I spoke against it at Jordan’s funeral,” Sharpton said.

“While [the grand jury] should be saluted for this righteous step, we wish the charge would have reflected what this really was: murder,” Sharpton continued, adding that his National Action Network would “continue to monitor this case to ensure this killer is held accountable and there is justice for Jordan.”

The Manhattan District Attorney’s office declined to comment.

When reached by The Post Wednesday, the former Marine’s cousin said his lawyers have told the family not to make any further comments about the case.

“We’re just letting them handle it from now on, thank you,” Justine Baldwin said.

Penny’s arraignment has not yet been set.

The next day after the story broke the local news shows didn't get the memo yet, and reported it for what it was. People filmed Neely terrorizing the car he was in, and at one point sat down next to a 20-something year old female commuter, and was poking and prodding at her as she was crying out for somebody to Help Me!!
The media memo was then released to all the networks about how this was to be viewed. You NEVER saw that clip again. All that was being reported was what a Boy Scout this Neely guy was, a talented Michael Jackson impersonator who was a little troubled at times. Oh, what a loss to society, arrested 19 times in the last 3-4 years, harmless and misunderstood, unless of course, you don't count his violent outburst that crippled an innocent 65-year-old grandmother for no apparent reason.
The Al Sharptons rushed to his defense because after all, we got a white guy killing a black guy and there's money to be milked out of this story, no need to examine the facts and circumstances or truths in this story. Thats secondary....People are waking up and seeing Bulls**t for what it is. Let's hope a jury of 12 sees it the same way.

We can BOYCOTT the librtal cessppol cities and their vile demon possessed populations. How about we change I love New York to I hate New York City. Seriously. Any liberal city that indicts, convicts, a patriot in a case like this JUST ban them. The liberals do it all the time.

I saw how much the family is crying. But I have a question if he was so loved a such a great guy why was he living on the street and not with them. Violent drug addicted person that’s why some of them have said that. But we going to forget about that because we are using his death like a winning lottery ticket.

Traditional Americans need to walk away from the leftists... let them drown in the filth and depravity of their moral bankruptcy.... the Leftists must be allowed to die.... they will destroy us all if we try and save them!

99% probability the girl on the train was a raging lefty.... Penny will go to prison and the lefty won't even remember his name!

It boils down to, the blue cities are taking away the right to defend oneself - and innocents around you. I've been chastised for doing the same since I was 16. When adults at an event wouldn't take charge of the situation and defend me - I did.

NO WHERE in the liberal catechism am I required to become a victim in order to be a "human being" and the constitution upholds my right to defend myself. If, in reality, these cities are going to criminalize those of us who will defend ourselves... then, better to carried by 6 than judged by 12. I accept the consequences of my actions, in these circumstances. But I will NOT let this warped sense of "right & wrong" change my own understanding.

In a reality, WRoL, prosecuting the "good guy" preserves the security ONLY of the dick taters. And it seems "you are here".

Given the average NY jury member rides the subway, there might be more of a chance that you think... especially since Mr Penny didn't use a weapon of any kind. An awful lot of NY commuters must be thinking, "gee, if I shove that creepy molester away from my daughter, and he hits his head, they're going to charge me!?"

I am sick and tired of the good guys being railroaded

Good Marine. Good intentions to simply subdue. A Bad application of a choke intended to subdue a crAzy person.

A properly applied carotid ‘blood’ choke can black out an individual within a few (as 3-seconds) give or take.

The inside of the forearm makes for a poor blunt instrument in filling the carotid artery.

The art of the blood choke can be accomplished with a single finger and thumb grasp with an experienced strong hand. I am not suggestion that easy to break hold, just something to keep in mind as to the complementing anatomy in subduing by filling the carotid artery ‘valley’ as some MMA practitioners refer to it as.

ETA:

I had the perfect post explaining the difference between a good blood choke & a poorly or inappropriately applied blood choke, resulting in extended oxygen depletion to the entire system as it inhibits full breath lung capacity during the struggle.

Two things submit struggle, properly applied pressure points on nerve centers, EXTREME PAIN AVERSION, or a properly fitted blood choke that create the 3-second black-out.

A security issue and a refresh stole my experience.

Fyi I think MACE is illegal on a subway along with nearly ALL other defensive weapons. Finally, I understand the NYPD police chief just resigned a day or so ago. He can see what is coming.
