New Documents Show Extensive Collaboration Between IRS, DOJ to Criminally Prosecute Conservative Groups

Last year emails revealed former IRS official Lois Lerner was in contact with the Department of Justice Criminal Division about criminally prosecuting conservative tea party groups for pursuing political activity (opposed to President Obama's agenda) by "posing" as non-profit organizations.

Now, new documents obtained by government watchdog Judicial Watch through two different Freedom of Information Act lawsuits show extensive collaboration between the IRS and DOJ (and subsequently the FBI) to go after conservative groups with criminal charges. The IRS likely violated federal law by illegally sharing 1.25 million pages of taxpayer information with DOJ, which were contained on nearly two dozen FBI backup tapes. Further, information shows DOJ wanted IRS officials who were scheduled to testify in front of Congress about the targeting scandal to turn over planned remarks to them first before delivering on Capitol Hill. Judicial Watch today released new Department of Justice (DOJ) and Internal Revenue Service (IRS) documents that include an official “DOJ Recap” report detailing an October 2010 meeting between Lois Lerner, DOJ officials and the FBI to plan for the possible criminal prosecution of targeted nonprofit organizations for alleged illegal political activity.

The newly obtained records also reveal that the Obama DOJ wanted IRS employees who were going to testify to Congress to turn over documents to the DOJ before giving them to Congress. Records also detail how the Obama IRS gave the FBI 21 computer disks, containing 1.25 million pages of confidential IRS returns from 113,000 nonprofit social 501(c)(4) welfare groups – or nearly every 501(c)(4) in the United States – as part of its prosecution effort. According to a letter from then-House Oversight Committee Chairman Darrell Issa (R-CA) to IRS Commissioner John Koskinen, “This revelation likely means that the IRS – including possibly Lois Lerner – violated federal tax law by transmitting this information to the Justice Department.”


But the IRS wasn't simply sending the DOJ information, Lerner herself was meeting with DOJ officials to discuss pursuing criminal charges.

On October 8, 2010, Lois Lerner, Joe Urban [IRS Technical Advisor, TEGE], Judy Kindell [top aide to Lerner], Justin Lowe [Technical Advisor to the Commissioner of Tax-Exempt and Government Entities], and Siri Buller met with the section chief and other attorneys from the Department of Justice Criminal Division’s Public Integrity Section, and one representative from the FBI, to discuss recent attention to the political activity of exempt organizations.

The section’s attorneys expressed concern that certain section 501(c) organizations are actually political committees “posing” as if they are not subject to FEC law, and therefore may be subject to criminal liability. The attorneys mentioned several possible theories to bring criminal charges under FEC law

Keep in mind Lerner previously and essentially stated in an email that at least one conservative group needed to be made a public example with prosecution.

"One IRS prosecution would make an impact and they wouldn't feel so comfortable doing the stuff," Lerner said in a 2013 email.

The goal was to stop the flow of other conservative non-profits, opposed to President Obama's agenda, from applying for tax exempt status and therefore becoming more effective.

“These new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” Judicial Watch President Tom Fitton said in a statement. “The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection. And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information. How can the Justice Department and FBI investigate the very scandal in which they are implicated?”

It's no wonder Lerner's hard drive magically "crashed," "losing" thousands of emails sent and received during the time period when she was meeting with DOJ to pursue prosecution of American citizens exercising their constitutional right to free speech.

IRS Fails to Meet Deadline to Produce Lois Lerner’s Emails

Emmet G. Sullivan, United States district judge for the District of Columbia, ordered the IRS last week to begin producing every Monday nearly 1,800 newly recovered Lois Lerner emails. On Monday, the IRS defied the order.

The developments come in the wake of Judicial Watch’s FOIA lawsuit seeking documents about the Obama IRS’ targeting and harassment of conservative non profits (Judicial Watch, Inc. v. Internal Revenue Service

Thanks to Judicial Watch’s litigation, the IRS was forced to admit that Lerner’s emails were supposedly missing and, then, that the emails were on IRS back-up systems.

Judge Sullivan ruled on the matter on July 1, 2015, and on Monday July 6, 2015, the IRS failed to produce a single email.

The IRS also failed to provide Judicial Watch a status of the Lois Lerner email production issues, as also ordered by Judge Sullivan.

The Treasury Inspector General for Tax Administration (TIGTA) recovered the emails from IRS back-up tapes. TIGTA was able to locate the Lois Lerner back-up tapes within one day of requesting them from the IRS.

A report released today by TIGTA on the Lois Lerner email controversy confirms that the IRS failure to timely search its back-up tapes resulted in 24,000 Lois Lerner emails being destroyed. The TIGTA report also confirms that IRS Commissioner John Koskinen delayed informing Congress (and the courts) for months about Lois Lerner’s email issue. (Judge Sullivan ordered the IRS to produce the TIGTA report to chambers the next day for in camera review at the July 1 hearing.)

Judicial Watch President Tom Fitton is calling for the resignations of IRS Commissioner John Koskinen and IRS Chief Counsel William J. Wilkins.

And Judge Sullivan is not one to be trifled with. He once sicced a special prosecutor on the DOJ for its corrupt prosecution of United States Senator Ted Stevens.

As Sidney Powell noted in the NY Observer last year, “Sullivan held federal prosecutors in contempt, dismissed an unjust indictment against a United States Senator, and publicly excoriated the Department of Justice.”


In the Stevens case, Judge Sullivan publicly upbraided the government lawyers before an overflow courtroom, “In nearly 25 years on the bench, I’ve never seen anything approaching the mishandling and misconduct that I’ve seen in this case. . . . When the government does not meet its obligations to turn over evidence, the system falters.”

Judge Sullivan was taking the extraordinary step of appointing a special prosecutor. He chose highly respected DC attorney Henry Schuelke III to investigate the prosecutors for possible criminal charges. The judge ordered the department to preserve all of its files, electronic correspondence—everything—and cooperate fully in the investigation, including providing Schuelke access to investigative files and all witnesses.

The IRS is skating on thin ice.

President Obama’s IRS conspired with the FBI and Department of Justice to not only harass conservative nonprofits, but also land political opponents in jail ahead of the 2012 presidential election, documents obtained by a watchdog group show.

The three agencies worked out “several possible” plans for bringing “criminal charges under FEC law” against conservative groups before the election, and the Justice Department might have been directly involved in a cover-up after Congress began investigating, according to documents obtained by Judicial Watch.

The documents show “that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” Judicial Watch President Tom Fitton said in a news release.

The evidence uncovered as part of a lawsuit filed under the Freedom of Information Act shows the IRS handed the FBI and Justice Department confidential tax return information for 113,000 nonprofit 501(c)(4) groups as part of a plan to land political opponents in legal trouble – despite federal law banning the agency from sharing such information.

“The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his re-election,” Fitton said. “And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information.”

When Congress began investigating IRS treatment of conservative groups seeking nonprofit status, the DOJ again got involved by asking IRS employees who were testifying to turn over documents before giving them to Congress, according to Judicial Watch.

The Obama administration maintains that the Justice Department is independent enough to conduct a “thorough” and “transparent” investigation of the IRS scandal, but the newly released information demonstrates that the agency might be far more complicit than originally appeared.

“How can the Justice Department and the FBI investigate the very scandal in which they are implicated?” Fitton asked in the release.

In a sane world, the answer would be that they can’t. But – in a sane world – Americans wouldn’t be afraid of criminal charges or tax audits for simply speaking out about a Presidential administration either.

Emails reveal plot to put Obama's political enemies in jail before 2012 election

According to a Tuesday story in the Washington Examiner, the IRS was not the only part of the Obama administration that was weaponized and used against the president�fs political opponents. Newly released emails, courtesy of a Freedom of Information Act request by Judicial Watch, reveal that the Justice Department and the FBI were also suborned to attack the Tea Party and other conservative groups. The plot, initiated by former IRS official Lois Lerner, was to use federal election laws to put people who opposed the president in jail in advance of the 2012 elections, according to a Judicial Watch spokesperson.

The IRS, at the request of the Justice Department, also turned over confidential tax records of Americans to federal law enforcement to fish for evidence for prosecution against conservative non-profits. The latest revelations suggests that a systematic campaign took place to violate the civil rights of Americans who opposed President Obama and to use the might of the federal government to suppress dissent using a strategy more resembling something that would happen in a police state than in a democracy.

In the meanwhile, the IRS has continued to stonewall efforts to obtain emails sent by Lerner about the plot, in violation of an order of a federal judge. The IRS had previously claimed that the emails in question had been destroyed, but then was forced to admit that they had been found on a backup system. The tax agency is playing with fire by defying a federal judge, however, which suggests that whatever is in the emails is explosive.

The unfolding scandal suggests the need to appoint a special prosecutor. The Justice Department obviously has a conflict of interest and is unable to, in essence, investigate itself. Thus far the Obama administration has resisted calls for a special prosecutor, a development that could cause headaches in advance of the 2016 elections.
